He explains that a perfect example came from a doctor who failed to document his recommendations for an elective colon screening. The patient chose not to receive the screening, thereby not detecting the nascent colon cancer. This patient later sued the doctor for failure to diagnose, and won because the doctor had no paper records of his recommendations.”
